SEATTLE - Washington's annual Hempfest - a three-day celebration of pot, bongs and hemp bead necklaces that is typically one of Seattle's largest festivals - was uncharacteristically worked up Saturday over what should have been cause for laid-back cheering: a fast-gaining ballot initiative to legalize possession of small quantities of marijuana.

Ballot measures to legalize marijuana are sprinting toward the polls in three Western states in November. Marijuana supporters say Washington's vote on Initiative 502 is important to maintain national momentum on an issue that is beginning to see steady gains in popular support.

For the first time, it is possible to envision an end to marijuana prohibition. That is a huge change -- a huge possible change that hasn't happened yet. But prohibition replaced by what? Any new regime will have to be acceptable to a majority of people -- and not just a majority of revelers at Hempfest or voters in liberal Seattle.

Agency Dismisses Legal Objections

Tax enforcers have started auditing medical-marijuana dispensaries in Washington, escalating a dispute over whether the outlets should be collecting money for state government.

The state Department of Revenue has worked since 2010 to tell marijuana establishments that they must remit sales taxes on their transactions. Some 50 dispensaries have registered with the state, helping the state collect some $750,000 in taxes from the industry over the span of one year.

PALM COAST -- Palm Coast officials are working on an ordinance to ban the sale of "herbal incense" by targeting its effect rather than the ever-changing chemical brew chemists cook up to stay ahead of the law when producing synthetic marijuana.

The draft ordinance would ban products that mimic the effects of a controlled substance that could be easily placed into pipes, cigarette papers and other paraphernalia for smoking or inhaling.

The makers of synthetic marijuana have been able to continue selling it as herbal incense because state laws target chemical compounds. Chemists spray chemicals similar to the THC in marijuana onto blends of leaves and roots, which are then sold as herbal incense. Chemists merely alter the compounds enough to escape the law.

This fall the voters in the 6th District will have an opportunity rarely afforded to them - a chance to directly inform their representatives of an opinion via a public policy question on the ballot.

The question is: "Should the state senator or representative be instructed to vote for a resolution requesting Congress repeal the federal prohibition of marijuana, as the 21st Amendment repealed national prohibition of alcohol, so that states may regulate it as they choose?"

The question is a reference to HR 2306, The Ending Federal Marijuana Prohibition Act of 2011 introduced in congress by Ron Paul and Barney Frank. Massachusetts Representative Michael Capuano signed on as a co-sponsor last September, and the bill has significant bipartisan support.

ST. THOMAS - As the territory waded this week into a politically charged discussion about whether medical marijuana and industrial hemp should be legal, top law enforcement officials responded with a reminder: weed is still against the law.

You would not necessarily know that from listening to some of the testimony offered Monday and Tuesday in the V.I. Legislature.

At least three St. Thomas residents openly attested to buying and smoking marijuana to relieve a host of medical ailments, from neurological injuries to psychiatric conditions. Some said they feared arrest and prosecution for the steps they take to treat their illnesses. Others criticized police and prosecutors for allowing simple possession cases to clog up the legal system.

As Secretary of State Al Jaeger reviews a medical marijuana ballot initiative, a Montana state legislator recommends sending it through the state assembly instead.

In 2004, Montana passed a medical marijuana initiative through a general election which was hard to regulate, said Montana State Sen. Donald Steinbeisser, R-Sidney.

"The problem we had in Montana, before the last session, over half of the people that were using medical marijuana cards were 20- to 30-year-olds," he said. "You know dog-gone well there's something wrong with that."

I want to thank the Drug Enforcement Administration for making it utterly impossible for any pharmacy or pain-management clinic to fill valid scripts anymore. Not a pharmacy in Broward County can supply those of us who legitimately require pain relief in order to function.

The feds have terrorized clinics, pharmacies, their distributors and even hospitals.

Do they think that everyone in South Florida is having a good time with oxycodone or any other opioids? I'm not. In fact, thanks to their overzealousness, I've been unable to work or, for the most part, even leave the house for two weeks, with no end in sight. I'm weak as a kitten and have little appetite, lost about 15 pounds and had little help from the medical community because it is terrified, too. I have scripts, but no one can fill them.
