No American Has Ever Been Granted Canadian Refugee Status Because of the War on Drugs, but the Times They May Be Changing.

To shirts at the Drug Enforcement Administration (DEA), she's a dangerous criminal on the run from justice, a big-time narcotics dealer who should be punished more severely than rapists and murderers. To her friends and supporters, she's a symbol of the drug war run amok, a political victim of the U.S. government's vendetta against medical marijuana.

Nightmares about abuse in prison and separation from her son have plagued Renee Boje for more than four years as she awaits a decision on her extradition to the United States.

Boje, a Commercial Drive resident and American citizen, was arrested on charges involving medical marijuana in California in July, 1999. She fled to Canada on the advice of counsel and the U.S. sought to extradite her back to the States. Her appeal against the extradition has been on hold in B.C. Supreme Court since 2000, pending an appeal by Boje to the federal justice minister. Boje's fate now rests with Irwin Cotler, the most recent minister of justice.

A hallucinogenic drug banned in Australia and listed by the U.S. Drug Enforcement Agency as a drug or chemical of "concern" is freely available for sale in Vancouver.

Renee Boje, owner of Urban Shaman on Hastings Street, sells salvia divinorum, a species of sage which belongs to the mint family, in the form of dried leaves, extract and plant cuttings. The plant is commonly used by Mazatecs in Mexico for curing rituals and divination. Boje says the leaves and extract are the most popular items sold at her store.

Gay Couples Follow a Trail North Blazed by Slaves and War Resisters

VANCOUVER, British Columbia -- Heaven was the word for Canada and the Negro sang of the hope that his escape on the Underground Railroad would carry him there," the Rev. Dr. Martin Luther King Jr. once noted in describing the codes American slaves used in their spirituals to fool their masters before taking flight.

Canada is heaven again for Lance W. Bateman and William E. Woods, two American men who were married here recently.

The self-proclaimed Prince of Pot, Marc Emery, is on a coronation tour of Canada promoting his belief that marijuana is legal.

The publisher of Cannabis Culture, founder of the BC Marijuana Party and owner of Marc Emery Seeds Direct has been smoking grass on the steps of police stations across the country at the international stoner hour of 4:20 to varied responses.

On the kick off for the Summer of Legalization Tour he smoked a cannon of a joint in front of the Toronto police station while cuddling a pot plant and didn't get arrested.

It's 10 a.m. and the pungent odor of pot lingers around the headquarters of the Marijuana Party on West Hastings Street.

It doesn't take a sleuth to know the law is being broken here. Check out the law books. It is still an offence in Canada to possess and smoke marijuana.

Yet no police hover nearby ready to swoop.

Inside sits 40-year-old Chris Bennett. He is content. He has already had a joint with his morning coffee.

For Renee Boje, Canada is freedom.

Facing charges in the U.S. of conspiracy to cultivate and distribute grass, she fled to Canada five years ago where she has built a blissful life with a husband and a baby.

"But I have nightmares that haunt me, nightmares that I will be forced to go back to the U.S.," Boje said.

Boje was arrested in California in 1997 for cultivating medical marijuana plants. Initially, her charges were dropped. But in May of 1998, nearly ten months after she was first arrested, Renee's attorney Kenneth Kahn told her the charges against her would most likely be reinstated.

31 CN BC: Immigration Hearing Halted After Three DaysSun, 16 Mar 2003

An immigration hearing for U.S. pot activist Steve Kubby was halted suddenly last week when Kubby fell ill after only three days of testimony in Vancouver.

Kubby was admitted to St. Mary's Hospital in Sechelt over the weekend with a 102-degree temperature and double pneumonia. He was allowed to go home Monday, but as of press time was still on IV antibiotics and was ordered to stay in bed.

The medical marijuana activist is seeking political asylum in Canada because he feels he will be prosecuted for his pot use if he returns to his home in Placer County, California. The immigration hearing, which began March 5, was halted on Monday (March 10) after Kubby's wife Michele asked the immigration board for a three-week adjournment in the hopes her husband could be well enough to be present at the hearing.

SECHELT, B.C. -- Steve Kubby is hoping his days in Sechelt provincial court are finally over.

Kubby learned this week that an order has been issued asking the Sunshine Coast RCMP to return his marijuana and property that was taken in a police raid last April.

"We did have the law on our side and we were prepared to go to the Supreme Court, but it's nicer to do it in a friendly way," Kubby said. "I think Sechelt can set an example for cases around the world. I can't say enough about the judge and everyone involved. They have all been so helpful. We're here in Canada because the Charter of Rights is respected and upheld."

Along the rugged coastline of British Columbia, more than a generation ago, the first American refugees trickled in. As the Vietnam War raged, draft dodgers who chose to flee America rather than fight an unacceptable war gravitated to Canada's west coast, to rain-washed Vancouver and northward in tiny villages astride deep fiords left by the glacial past.

A few of the new arrivals brought with them a taste for marijuana, and some began cultivating pot gardens. Isolated from the law by rugged terrain, separated from most of civilization by deep bays, a marijuana industry was born. As the tale goes, the coast north of Vancouver became a pot lover's paradise.

VANCOUVER, B.C. -- The door-kicking has stopped, as have the asset forfeitures and harassment. Chris Bennett hasn't been arrested in weeks, nor have any of his friends.

Yet, the 40-year-old Bennett isn't inclined to say the battle is won.

He's seen the police relax before. He's seen pot achieve a tenuous level of respectability when a more liberal-minded mayor or police chief takes over. And he's seen the subsequent backlash.

"Every time we talk to the press, something happens," he said, sitting in the store he manages, The Marijuana Party Headquarters.

Here's How Hollywood-Raised Renee Boje Became The Pot Madonna

Gorgeous, guileless and naturally blissed out, Vancouver's Renee Boje, 32, is the perfect poster girl for pot activists; she's also a new mother and martyr for a cause she never dreamed she'd represent, a marijuana madonna with everyone from Noam Chomsky to Woody Harrelson writing letters on her behalf.

Boje lies back on the couch, her baby Shiva curled against her breast. Images of Ganesh and Shakti smile down from the walls. Outside, the traffic on Commercial Drive has almost faded. Across the room Shiva's father, author Chris Bennet, talks quietly about ancient Egypt.

Bush's Crackdown On Drug Clubs Sending Many Into Hiding

VANCOUVER, British Columbia - Four decades ago, a wave of American draft dodgers fled to Canada rather than fight in Vietnam. Some turned to planting marijuana seeds to make a living and spurred an underground industry that is now booming across British Columbia.

Over the last year or so, a new generation of Americans has flocked into western Canada, fleeing the Bush administration's crackdown on the clubs that say they provide marijuana to sick people, particularly in California.
