THREE MONTHS LATER, NO DECISION YET ON MEDICAL POT BUST

There remains no decision on whether to pursue charges against the owner and caregiver of a Handy Township medical marijuana dispensary that was raided by drug officers three months ago today.

Prosecutor David Morse said his office has made no decision about charging Christi Marshall, owner and caregiver at Marshall Alternatives at 165 Fowlerville Road.

Although Marshall said her business sold medical marijuana, Morse has previously said the lab results will be needed before deciding whether to file charges.

It was not immediately known Wednesday whether the lab reports had been received.

"It is routine to wait for lab reports to come back," said Wilson Tanner, Marshall's attorney.

The Livingston and Washtenaw Narcotics Enforcement Team raided the dispensary March 2, during which an undisclosed amount of marijuana and as much as $15,000 worth of property was seized, the owner's legal counsel said.

Tanner said the marijuana "is preserved," and the medical records seized during the raid "are under seal."

Marshall has said her patients, who included people with terminal throat cancer and seizure disorders, have never left her facility with more than the 2.5-ounce limit allowed under the Michigan Medical Marihuana Act, which voters approved through a statewide ballot question in November 2008.

"The confusion and difficulty in interpreting this law puts everybody in limbo," said Tanner, who defined "everybody" as Marshall and her customers.
